New Wyoming Law Excludes Accrued Vacation from Wages at Termination

Effective July 1, 2013, the value of accrued vacation leave is excluded from the definition of "wages" if the employer has a written policy stating that accrued vacation is forfeited upon termination of employment and the employee has acknowledged the written policy in writing. Under current law, vacation pay is considered a fringe benefit included in the definition of wages and employers must pay it on termination regardless of whether they have such a policy.
