Notice of Exchange Requirement Under Affordable Care Act Delayed

Under the Affordable Care Act (ACA), employers are required to provide employees with written notice explaining the availability of health care exchanges. Employers initially had a deadline of March 1, 2013; however, on January 24, 2013, the Department of Labor (DOL) announced that this deadline will be delayed. The announcement was made as an update to Frequently Asked Questions (FAQs) regarding the ACA.

The DOL expects the new deadline for distribution of the notices to be in the late summer or fall of 2013 to coordinate with the open enrollment period for exchanges. The DOL is considering model language that could be used to satisfy the notice requirement. Future guidance on complying with the notice requirement is expected to provide employers with flexibility and adequate time to comply.
