Marcia A. Washkuhn

Marcia A. Washkuhn, a partner in Kutak Rock LLP's litigation department, chairs the Omaha, NE office's employment group.

Ms. Washkuhn has extensive experience handling a variety of labor and employment matters across the US, including claims asserted under Title VII, the FMLA, ADA, ADEA, USERRA, Equal Pay Act, Pregnancy Discrimination Act and the FLSA, as well as similar state discrimination and wage payment laws.

She also regularly provides day-to-day advice to employers on a wide array of employment issues, including wage payment matters, self-audits, interviewing, drug testing, background checks, recordkeeping requirements, unemployment, workers' compensation and employee discipline.

In addition, Ms. Washkuhn has significant experience drafting and providing advice on employment contracts, restrictive covenants, severance agreements, job descriptions, employment applications, employment policies and employee handbooks, and she regularly provides advice on employment issues arising from reductions in force, mergers, acquisitions and reorganizations.

She is admitted to practice in Nebraska, Iowa, the US District Court for the District of Nebraska, the US District Court for the Southern and Northern Districts of Iowa, the US District Court for the District of Colorado, the Court of Appeals for the Eighth Circuit and the Court of Appeals for the Tenth Circuit.
