Arizona Declaration of Independent Business Status

When to Use

An employer in Arizona can establish a rebuttable presumption of the existence of an independent contractor relationship under the state's labor code (meaning courts will presume a worker is an independent contractor and not an employee unless the worker proves otherwise) by having the worker execute a Declaration of Independent Business Status, and then "acting in a manner substantially consistent with the declaration."
