When to Use
At the time leave is requested, you should provide the employee a notice explaining what the "key employee" exception is and that the employee is considered a "key employee" under the regulations and that he or she may be denied reinstatement. The employee is still entitled to take FMLA leave and to receive all benefits during the FMLA leave.
