Comply With a Creditor Garnishment
- Employees are often subject to a court ordered creditor garnishment to pay an outstanding debt, such as an unpaid loan or credit card amount, among many other types of debts.
- If so, the court will send the employer an order requiring it to withhold from the employee's wages according to the terms of the order.
- Employers must know how to calculate withholding, bearing in mind that if the federal minimum wage rate changes the amount that can be garnished changes as well. Employers also need to know the order of priority when there are multiple garnishments against one employee, and when to follow state law.
