  • OSHA will fine employers who appear to encourage dangerous activities such as texting, using the phone or drinking while driving.
  • To make sure this does not happen, employers should have a policy for how workers should behave while behind the wheel. In furtherance of the policy, the employer should refrain from creating expectations for employees that almost ensure that dangerous activities will be done behind the wheel.
  • Having a policy is not enough, however. Employers should also strictly enforce the policy. A policy that is lax in its application is worse than not having a policy at all.
