Editor's Note: Employees generally must be paid for time spent attending training, lectures and meetings unless certain conditions are met.

Michael CardmanOverview: When employers require their employees to undergo training or be present at a company meeting, that time counts as hours worked under the federal Fair Labor Standards Act (FLSA) and many state wage and hour laws. The employees must be paid at least the minimum wage for their time, and it also counts toward overtime. But if attendance is voluntary, then the time your employees spend at training, lectures and meetings and similar activities could be excluded from compensable hours worked if certain conditions are met.

Trends: Courts have disagreed over whether training can be considered voluntary if employees are required to complete post-hire training as a condition of employment post-hire, if it is required by law or if it is necessary for employees to maintain their skills.
