Create a California Consumer Privacy Act-Compliant Workplace Privacy Policy Checklist

When to Use

The California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), provides consumers with certain privacy rights regarding their personal information, including employment-related personal information. The CCPA defines a consumer as a California resident under the state tax code. Consumers include a covered business' California job applicants, employees, and independent contractors.

Covered businesses under the CCPA have a number of compliance obligations, including preparing and posting a privacy policy that includes all of the information required by the CCPA and its Regulations. This required information includes specific disclosures about a business' information practices, an explanation of consumer rights under the CCPA, and information about how to exercise those rights.

California employers that are CCPA-covered businesses must likewise have a privacy policy. However, California employers should ensure that they have a privacy policy geared toward applicants, employees, and independent contractors that addresses their employment-related personal information.

This checklist may be used by employers to help prepare and post a CCPA-compliant privacy policy for job applicants, employees and independent contractors. Employers should consider completing the following steps in sequential order to properly complete the checklist.
