Smoking and E-Cigarette Workplace Laws by State: New 50-State Chart Added

XpertHR has added a helpful new 50-State Chart to its smoking in the workplace resources, Smoking and E-Cigarette Workplace Laws by State.

Every state has laws and regulations relating to smoking in the workplace, which may now also include the use of electronic cigarettes (e-cigarettes) or vaping products. Due to the differences among the laws, it may prove difficult for employers to track and comply with their state's legal requirements.

This chart details the workplace smoking and e-cigarette laws for private employers in each state and the District of Columbia, including:

  • Whether smoking and/or e-cigarette use is prohibited;
  • Abbreviated definitions of relevant terms provided under law, e.g. smoking, workplace;
  • Posting and policy requirements, where applicable; and
  • Whether employers may provide smoking rooms/areas.

This chart also links to state-specific Smoke-Free Workplace handbook statements to assist employers in informing employees that smoking is prohibited in the workplace and to demonstrate compliance with the law.
