Summary

  • An Indiana employer may file a civil action against an individual drug user for damages caused by the individual's use of an illegal drug. See Drugs and Alcohol.
  • Employers may implement and enforce policies that prohibit the use, sale, possession, distribution, purchase and cultivation of drugs and alcohol in the workplace. See Drug and Alcohol Policies.
  • Employers in Indiana are not prohibited from testing employees and job applicants for drug and alcohol use at work or during work hours. See Drug and Alcohol Testing.
  • Indiana prohibits smoking in enclosed areas of places of employment and within eight feet of any public entrance to a place of employment. See Smoking.
