Summary

  • With limited exceptions, Tennessee is an at-will employment state. See Employment At-Will.
  • Tennessee law provides that any employer responding to a request from a prospective employer who provides truthful, fair and unbiased information about a current or former employee's job performance is presumed to be acting in good faith.   • Tennessee employers are prohibited from discriminating against employees in regard to performance appraisals on the basis of race, creed, color, religion, sex, age, national origin, disability or in retaliation for making a claim of unlawful discrimination.
