Summary

  • The West Virginia Human Rights Act (WVHRA) is the state counterpart to the Title Vll and other federal antidiscrimination laws. It prohibits discrimination and harassment based on race, religion, color, national origin, ancestry, sex, disability, blindness or age. See Discrimination Under the West Virginia Human Rights Act.
  • Remedies under the West Virginia Human Rights Act include reinstatement, back pay or any other legal or equitable relief, and the costs of litigation including attorney and witness fees. Employees may also recover punitive damages as well as damages including front pay and emotional distress damages. See Remedies.
  • The West Virginia Equal Pay for Equal Work Act provides exceptions to the rule of equal pay for equal work between the sexes. See Equal Pay.
