Summary

  • Employers that receive child support withholding orders are required to immediately withhold the amount stated on the order and remit the funds within seven business days after payday. Child support orders have priority over other types of garnishments. Special rules apply to interstate withholding orders. See Child Support Withholding.
  • Alabama limits the amount of disposable income that is subject to creditor garnishment. Employers must begin remitting withheld amounts after 30 days from the first date that amounts were withheld. See Creditor Garnishment Withholding.
  • Voluntary wage assignments are void in Alabama; thus, employers need not comply with them. See Voluntary Wage Assignments.
  • The state has the right to garnish wages to collect unpaid taxes. The amount of withholding is limited. See Tax Levies.
