Author: Angela Rud, formerly of Lathrop GPM

Summary

  • Minnesota courts recognize negligent hiring claims against employers. Therefore, Minnesota employers have a duty to use reasonable care in the selection and hiring of employees. If an employer hires an employee that it knows or should know may cause harm, and the employee causes harm to another, liability may result. See Negligent Hiring.
  • Employers can minimize the risk of a negligent hiring claim by conducting background checks on prospective employees. See Minimize Risks of Negligent Hiring Claims.
