- South Carolina does not have state laws governing overtime pay for private employers. Consequently, South Carolina follows the overtime laws set by the federal Fair Labor Standards Act (FLSA). See Overview.
- South Carolina requires state agencies to develop overtime policies for state employees that comply with the FLSA. State agencies may provide employees compensatory time off instead of overtime pay. See Public Employers.
