Does an employer have to create a safety program?

No. Except in the instance of federal contracts or federally assisted contracts, a safety program is not mandatory. However, an employer may still want to implement one to help make health and safety in the workplace a top priority and to demonstrate to the Occupational Safety and Health Administration (OSHA) the employer's good-faith effort to create a safe working environment.
