Documentation for Separation of Employment by State

Most states have requirements regarding the documentation an employer must provide upon an employee's separation from employment.

The following chart summarizes these requirements relating to unemployment compensation notices, as well as the various state mini-COBRA and end-of-employment service letter obligations. The chart also includes notice requirements for multistate workers and other required notices.

Note that the Worker Adjustment and Retraining Notification Act (WARN) and state mini-WARN Acts governing mass layoffs are not included on this chart. Those laws govern notice requirements that apply at least 60 days before an employee's separation from employment. Coverage of those laws may be found in Mass Layoffs, Reductions in Force and Plant Closings.

Cells marked with "N/A" signify either that the state's law does not address notice requirements or that the particular issue in question does not apply under that state's law.
