A number of states and municipalities have passed laws restricting an employer's ability to seek and/or consider a job applicant's salary history during the recruiting and hiring process. In addition, some jurisdictions have pay transparency laws that require employers to disclose the pay range for a position, either in the job posting itself or at some point during the interview and hiring process.
The following chart features states and key municipalities with salary history restrictions and/or pay transparency requirements that apply to private employers. Jurisdictions that have no laws addressing these issues are marked N/A. Note that all information on a jurisdiction's pay transparency laws is contained within the Pay Transparency Requirements column, while the other columns in the chart pertain to the jurisdiction's laws regarding salary history inquiries.
