When to Use

An employer that voluntarily continues to offer leave under the Families First Coronavirus Response Act (FFCRA) framework should use this letter to document its decision to approve an employee's request for leave under the Emergency Paid Sick Leave Act (EPSLA) and/or the Emergency Family and Medical Leave Expansion Act (EFMLEA) provisions of the FFCRA.

Appropriate written documentation of an employee's leave request will help substantiate an employer's eligibility for the paid leave tax credit.
