Lactation Accommodation Policy

The PUMP for Nursing Mothers Act requires nonexempt employers that are subject to the Fair Labor Standards Act (FLSA) to provide to provide "reasonable" break time for an employee to express breast milk for a nursing child for one year after the child's birth.

Employers are also required to provide a place, other than a bathroom, that is shielded from view and free from intrusion from coworkers and the public, which may be used by an employee to express breast milk.

Many states have enacted similar laws, which may provide greater rights than federal law.

An employer should consider implementing this policy to support compliance with the PUMP for Nursing Mothers Act.
