Overtime Policy

When to Use

The federal Fair Labor Standards Act (FLSA) requires employers to pay nonexempt employees one and one-half times their regular rate of pay for all overtime hours - generally, any hours in excess of 40 hours per workweek.

Some states impose additional challenges, such as stricter criteria for exemptions and/or daily overtime requirements.

An employer covered by the FLSA and/or by any state overtime law should consider implementing this policy to set expectations for employees and to help ensure compliance.
