Make a Conditional Employment Offer
- It is not uncommon for an employer to condition an offer of employment on the successful completion on certain additional requirements prior to the start date. These requirements could include a background check, verification of education history, medical exam and/or drug test.
- Before conducting any background checks, review federal, state and local law requirements and/or limitations regarding an employer's use of credit and criminal history in hiring decisions. Also, check state or local law to determine whether drug screening is allowed.
- If an offer is contingent upon certain agreements, such as a restrictive covenant, confirm whether those agreements are permitted under state or local law and if so, whether there are any particular requirements or procedures that must be followed.
