No. There is no legal requirement to offer health care benefits to employees and an employer may designate which category of employees are eligible to participate in the benefit plan, providing the selection criteria does not violate the law. Violations would be criteria based on gender, race, faith, national origin, sexual orientation, disability, or other protected status.
