Can withholding on a court-ordered payment be stopped if the balance is paid off?
Author: Ryan F. Donovan
No. Even if an employer believes a garnishment is paid off or the employee insists this is the case, the employer should continue to withhold per the order until it is given a release to stop doing so. If the employee overpays on the garnishment, the garnishing agency will address the refund. An employer should not do anything that can lead to it being deemed noncompliant with a garnishment. Lastly, even if an employer believes an order is paid off, the employer may not be aware of any additional penalties, interest or other revisions to the amount due.
