In order to minimize the risk of a pregnancy discrimination claim, an employer should have a discrimination and harassment policy specifically prohibiting discrimination based on pregnancy, childbirth and related medical conditions. This policy should be distributed to all employees and included in the employee handbook. The employer should provide training to all employees and supervisors so that they know how to identify and respond to instances of pregnancy discrimination. Further, an employer should set up a multichannel complaint system that permits employees to bring pregnancy discrimination complaints without fear of retaliation. Lastly, an employer should follow up on any complaints of pregnancy discrimination with a comprehensive investigation and discipline if needed.
