Summary

  • Several types of employees are exempt from Kentucky's minimum wage and overtime requirements. Kentucky law mirrors the Fair Labor Standards Act (FLSA) in most respects regarding the definition of exempt employees. See Minimum Wage and Overtime Exemptions.
  • However, Kentucky does not recognize all federal exemptions and also provides for several additional exemptions that are not included in federal law. To be exempt from overtime pay, an employee must be exempt under both the federal and Kentucky laws. See Other Kentucky-Specific Exemptions.
  • Kentucky also exempts certain employees from its overtime requirements, but not necessarily its minimum wage requirements. See Overtime-Only Exemptions.
