Paid Sick Leave Policy
Author: Stacy M. Bunck, Ogletree Deakins
When to Use This Policy
Paid sick leave is not required under federal law. However, paid sick leave may be required at the state or local level. See Paid Sick Leave by State and Municipality. This policy is designed for employers that are mandated by law to provide paid sick leave and that do not already have a paid time off policy that allows leave for the same qualifying reasons and under the same conditions (e.g., amount of leave, permit carryover of leave, allow temporary employees to take leave) as the applicable law. Because jurisdictions vary in their requirements, this policy must be tailored to fit the applicable law.
This policy does not address mandatory leave for qualified individuals under the Family and Medical Leave Act (FMLA) or the Americans with Disabilities Act Amendments Act (ADAAA), nor is it designed to cover sick leave for employees covered by a valid collective bargaining agreement (CBA).
