Pursuit of Same-Sex Harassment Cases Yields Mixed Results

Employers should proceed with caution when it comes to cases of same-sex harassment and discrimination. Although Title VII does not explicitly prohibit discrimination based on sexual orientation, this has not stopped the Equal Employment Opportunity Commission (EEOC) and victims from pursuing cases of same-sex sexual harassment or discrimination when the claims involve discrimination or harassment based on sex.
