Guide for global employers: Termination of employment

Authors: Matthew Howse and Lee Harding, Morgan Lewis & Bockius, LLP

Summary

  • When terminating employment relationships, global employers need to take into account the employment rights of employees under the law of the relevant country. (See Compliance)
  • In many countries there are restrictions on employers' ability to dismiss employees. To terminate employment relationships lawfully, employers may need to: provide a minimum period of notice; have a good cause for the dismissal; follow a prescribed procedure in implementing the dismissal; and make a severance payment to the employee. (See Notice periods, Dismissals with cause, Dismissal procedures and Severance pay)
  • Multinational employers could consider adopting minimum standards across the business that all managers must follow when dismissing employees. (See Global employers' approach to termination of employment)
