FLSA Tip Credit Rule Takes Effect

UPDATE - February 26, 2021: The US Department of Labor (DOL) delayed the effective date of the tip regulations from March 1, 2021, until April 30, 2021.

UPDATE - March 23, 2021: The US Department of Labor (DOL) issued two Notices of Proposed Rulemaking (NPRMs). The first proposes to withdraw and re-propose portions of the rule that narrow the circumstances in which the DOL can assess civil money penalties for violations and also solicits comments on whether to revise the portion of the 2020 final rule that addresses "managers or supervisors." The second proposes to extend until December 30, 2021, the effective date of portions of the 2020 final rule that address the assessment of civil money penalties and the application of the FLSA tip credit to tipped employees who perform both tipped and non-tipped duties (i.e., dual jobs).

UPDATE - April 29, 2021: The US Department of Labor (DOL) issued a final rule delaying the effective date of portions of the tip regulations until December 30, 2021.
