EEO - Retaliation requirements for other states

Federal law and guidance on this subject should be reviewed together with this section.

Authors: Evan Burkholder and Leslie Yulkowski, LeClairRyan

Summary

  • Michigan's employment retaliation laws are generally coextensive with their federal counterpart, and therefore look to federal courts for guidance. However, Michigan Courts do place additional requirements on a complainant. See Retaliation Under Michigan's Elliot-Larsen Civil Rights Act.
  • The cities of Detroit and Ann Arbor have local ordinances that allow employees to file internal complaints with the city or a department thereof for alleged retaliatory acts. See Retaliation Under Municipal Laws.
