USERRA requirements for other states

  • The Uniformed Services Employment and Reemployment Rights Act (USERRA) is a federal law that provides leave rights for public and private employees with military obligations. Idaho law will apply in instances where it provides greater benefits, protections and/or rights than federal law. See Idaho Military Leave.
  • Public employees returning from military duty are provided with additional benefits with respect to leaves of absence and job restoration and benefits. See State of Idaho - Military Leave.
  • Educational institutions in the state of Idaho must grant a military leave of absence to certain members of the military. See Educational Institutions.
