An employer must be careful when communicating with employees during the time leading up the secret ballot election. This is even more so critical under the so-called "ambush election rules" - rules adopted by the National Labor Relations Board (NLRB) and effective April 14, 2015 that shorten the timeframe from the filing of a union representation petition to the secret ballot election.
