How to Monitor Employee Use of Company Property Including Vehicles and Cell Phones

Employers often provide employees with property and equipment such as computers, cell phones, and vehicles to employees in connection with work-related duties and responsibilities. Accordingly, employers may restrict employee use of employer property, equipment and vehicles to work time only and condition use upon legitimate business purposes.

Because employee use of such property and equipment can lead to employer liability, employers should establish rules regarding proper use and monitor such use to ensure compliance with employer policies. However, an employer's right to monitor employee use of property equipment is not absolute.

The degree of monitoring that is permitted will depend in part on the reasonable expectation of privacy of employees in any given situation.
