Employee Rights and Responsibilities Under the Family and Medical Leave Act Poster
Entity Mandating Poster: Wage and Hour Division, US Department of Labor.
Applicability: Employers with 50 or more employees within a 75-mile radius covered by the Family Medical and Leave Act (FMLA). Employees must have worked for at least 1,250 hours over the previous 12 months to be eligible for FMLA leave.
Where to Post: Covered employers must post this notice in a conspicuous and prominent place where it can be readily seen by employees and applicants, even if no employees are eligible for FMLA leave. The poster and the text must be large enough to be easily read and must contain fully legible text. The notice may be posted electronically, as long as all other requirements are met.
Distribution Specifications: If there are FMLA-eligible employees, employers must provide this notice to each employee by including it in an employee handbook or other written guidance covering employee benefits or leave rights, if such written materials exist. This notice can also be distributed to each new employee upon hire. Electronic distribution is also allowed.
Obtaining This Poster: An employer may download this poster directly from the Department of Labor website. A Spanish version of the poster is also available. Although a new version of the poster was released in April 2016, the February 2013 version of the FMLA poster may still be used to fulfill the posting requirement.
