XpertHR is on track to have all 50 states and Washington DC by the end of July. We are completing states on a rolling basis until then and are now up to 23 states, with the completion of four states this week.

  • Indiana's minimum wage and overtime exemptions are different from those under the FLSA. One of the most significant differences is that the executive, administrative and professional exemptions all require the employee to have the authority to hire or fire.
  • Whereas the federal OSH Act penalizes willful violations, the Indiana OSH Act penalizes knowing violations. The Court of Appeals of Indiana has held that an employer's intentional disregard or plain indifference to safety standards is sufficient to establish that the employer knowingly violated the Indiana OSH Act.
  • Small employers in Indiana (2-50 employees) are eligible to purchase small group policies and may be eligible for a new program permitting small employer pooling to achieve a more affordable group rating.
