Arizona has amended its identity theft statute by making it a class three felony for an employer to commit the criminal offense of knowingly accepting the identity of another person if when hiring an individual the employer:

  1. Accepts any personal identifying information of another person from the individual and knows that the individual is not the actual person identified by that information; and
  2. Uses the identity information provided for the purpose of verifying whether the individual is legally authorized to work in the US through the Form I-9 process.

See +2014 AZ H.B. 2639.

This amendment is effective July 24, 2014. As a result of this development, the Arizona Immigration, Form I-9 and Work Visas and Interviewing and Selecting Job Candidates sections of the Employment Law Manual have been updated. In addition, an entry has been added to the Legal Timetable.
